The purchases made in different set-ups, whether in the Government or in the Public sector both Central/State, Municipal Corporations etc. are called Tenders. Government tenders, Procurement Notifications can be classified into following categories;

Tenders By Value:

Tenders can be classified by their value. Large value tenders are usually for Work (e.g. construction and Engineering projects) tenders. The tendering authorities like State Public Works Departments (PWD), Public Health Engineering Department (PHED) etc. calling these type of tenders empanel contractors in various class depending on their capacity to carry out such works, e.g.

A Class Contractors: Any Value
B Class Contractors: Upto Rs. 1,00,00,000
C Class: Upto Rs. 50,00,000 etc.

The total procurement through tendering by these entities gross up to Rs. 4,50,000 crores per annum. The Public Sector both Central and State Units form a sizeable share in Government purchases.

Type of Tenders

Tender can be classified based on the requirement category or Procurement Type. Main Categories of the Tenders are as follows:-

Works Tenders
       Works Tenders are invited through Open Tender Procedure for Roads, Bridges, Building Construction works, Canal
        & Irrigation Works, Civil Works etc.. This Open tendering process are further classified according to the Tender
        Cost of the works as under
        
        a. Normal Tender Procedure
           In this case the tenders are invited on single bid Envelop system from appropriate class of contractors of PWD / 
           PHED / CPWD / Other Government Authorities. At the time of opening of tender, EMD and proof of class of Contractor
           registration and other documents are checked. If found satisfactory, price bids are opened straight away and bid 
           evaluation is done as per the normal tendering procedure.

        b. Potential Assessment Method
           In this case, two bid envelope system is followed where envelope 1 is the technical bid containing information 
           regarding the potential assessment based on pre determined evaluation criteria and EMD. Envelope 2 is the 
           unconditional Price bid.
           
        c. Post Qualification Method
           In this case, two bid envelope system is followed where envelope 1 is the technical bid containing qualification
           bid in respect of information based on pre determined evaluation criteria and EMD.Envelope 2 is the unconditional
           Price bid only.
        
        d. Pre Qualification Method
           In this case, there is a uniform evaluation criteria prescribed for pre-qualification. In this process, initially
           a request for “Expression of Interest” (EOI) is published. The department, if required may take suggestions 
           regarding the techno-Commercial bid formats and the evaluation criteria from the contractors at the time of pre-Bid
           meeting. On the basis of the suggestions, Techno-Commercial bid and evaluation criteria is designed. On the basis of
           such standards and evaluation criteria the contractors are asked to submit their EOI. The EOI of the contractors
           submitted are evaluated. Only successfully pre-qualified contractors/ Bidders  are asked to submit their Commercial
           bid.
            
           However if the techno-Commercial details and evaluation criteria are predetermined and standard, the department opts
           to invite tender on such standards and evaluation criteria on Two Envelope bid system.
           
        Which are further classified according the Price bid Schedule:

                a. Item Rate Tender
                    In this case the contractors are required to quote the rates for each item mentioned in the price bid. The
                    quantity to be executed is given in the price bid.

                b. Percentage Rate Tender
                    In this case a detailed estimate of the quantity of work to be carried out along with the estimate rates is
                    given in the price bid form. The Contractors are required to quote the amount in percentage above or below.

                c. Turnkey Project 
                    In this case a complete estimate of work to be executed including Delivery, Installation,Inspection and
                    commissioning of a particular job is mentioned. The contractor is required to quote for all the items including
                    the supply and works.
    
    •  Goods Tenders
        o Fixed rate contract.
            In this type of contract where a set of rates and terms and conditions are fixed for  the supply of unit quantities of
            goods or certain standardized services;

        o Short Notice Tenders
            In short Tender Notice there is an urgent requirement of execution of works / Requirement of Goods & Services in
            short period of time and on immediate basis, short tender notices are invited.

        o Limited Tenders
          Limited tenders shall be   obtained    from   the S.S.I. units/whole Sellers/producers, original equipment 
             manufacturers,sole/distributors/ sole selling/ marketing agent/sub-distributors,authorised dealers, retail shops of
             Manufacturers, authorised stockiest, retailers of known reliability and who are bonafide dealers in stores/articles 
             to be purchased.  For this purpose the purchase officers shall maintain a list of such firms, of known reliability
             who deal in items and that they possess the necessary equipments and facilities for supply of stores  which they 
             offer. 
            
             Tender notice shall be given to sufficient number of firms to avail competitive rates. 

    •  Services Tenders
       
       o Pre Qualification or Two Bid Envelop System
            In this type of Tendering process the tenderers / Bidders  are  First screened for their capability and resources to
            implement the Contract before they are permitted to offer their tenders;
        
       o Turn-key contract
   

Publicity of Tender Notice

Details to be mentioned in notice inviting tenders.

The Notice Inviting Tenders shall contain the following details, namely:-

    o  The name and address of the procuring office and the designation 
        and address of the Tender Inviting Authority
    o  Name of the scheme, project or program  for which the procurement is to be effected
    o  The date up to which and places  from where the tender documents can be obtained
    o  The amount of earnest money deposit payable
    o  The last date and time for receipt of tenders
    o  The date, time and place for opening of tenders received 
    o  Any other information the Tender Inviting Authority considers relevant. 
  

Publication of Notice inviting Tenders in newspapers.-

The number, editions and language of the newspapers in which the notices inviting tenders shall be published will be based on the value of procurement

Sending Notice inviting Tenders to all possible Tenderers / Bidders.

The Tender Inviting Authority may if he considers necessary, send the Notice Inviting Tenders to all possible tenderers including registered contractor, past Supplier, any potential supplier and any other well known company or firm Directly.

NOTICE INVITING TENDERS AND TENDER DOCUMENTS.

Tender Documents mainly contains Technical Specifications, Commercial Term & Conditions, Bid Evaluation criteria, eligibility criteria etc.

    o Technical Specifications
         The technical specifications contained in the tender documents shall include a detailed description of what
         is proposed to be procured.

         In the case of construction or Works   tenders, detailed estimates (Tender Cost) shall be prepared by the 
         competent Tendering authorities based on the schedule of rates and standard data as revised from time to 
         time provided that for large and prestigious projects, the Government shall permit any procuring entity to
         engage a qualified private architect or consultant to prepare the design and estimates.  

    o  Commercial Conditions
         The tender documents shall require all tenderers without exception to pay an earnest money deposit (EMD) 
         ordinarily not exceeding one per cent of the value of the procurement by means of a demand draft,bankers
         cheque, specified small savings instruments or where the procuring entity deems fit, irrevocable bank 
         guarantee in a prescribed form.  The tender documents  shall clearly state that any tender submitted 
         without  the earnest money deposit in the approved form be summarily rejected provided that any category
         of tenderers specifically exempted by the Government from the payment of earnest money deposit will not
         be required to make such  a deposit. 
 
         The tender documents shall specify the period for which the tenderer/ Bidder should hold the prices offered
         in the tender valid

    o  Bid Evaluation Criteria
         The tender documents shall clearly indicate  the criteria  in addition to price which are to be adopted for
         evaluating the tenders and how such criteria will be quantified or evaluated

         The qualification criteria in terms of the registration of contractors in the cases where the procuring
         entity has a system of registration of contractors, the required Past experience, available manufacturing
         and construction capacity, technical and other manpower and financial status shall be clearly stated in 
         the tender documents.
Sale of Tender Documents

The Tender Inviting Authority shall make available the tender documents from the date of publication of the tender. The same Tender documents are also available online on respective website of Tender Issuing Authority, http://tenders.gov.in & Private Tender Information Portal like www.tradereader.com

Clarification to tender documents (Pre bid Meeting )

At any time after the issue of the tender documents and before the opening of the tender, the Tender Inviting Authority may make any changes, modifications or amendments to the tender documents and shall send intimation of such change to all those who have purchased the original tender documents and upload corrigendum for the information of those who have downloaded the tender documents from the website.

In case any one tenderer asks for a clarification to the tender documents before 48 hours of the opening of the Tender, the Tender Inviting Authority shall ensure that a reply is sent and copies of the reply to the clarification sought shall be communicated to all those who have purchased the tender documents without identifying the source of the query and upload such clarification to the designated website for the information of those who have downloaded the tender documents from the website, without identifying the source of the query

RECEIPT OF TENDERS ( Bid Submission)

Place and time for receipt of tenders-
The Tender Inviting Authority shall ensure that adequate arrangements are made for the proper receipt and safe custody of the tenders at the place indicated for the receipt of tenders. Such of the tenders that are received through electronic mail shall be kept electronically locked Tender Box.

The Tender Inviting Authority may extend the last date and time for receiving tenders “Which shall be published on the designated website also” after giving adequate notice to all intending tenderers in cases where

Opening of tenders

All the tenders received by the Tender Accepting Authority shall be opened at the time specified in the Notice Inviting Tenders (NIT) and in cases where an extension of time for the submission of tenders has been given subsequent to the original Notice Inviting Tenders in accordance with sub-rule (5) of Rule 18 at the time so specified subsequently. The e-submitted tenders may be permitted to be opened by a Tender Inviting Authority or a member of the Tender Scrutiny Committee from their new location if they are transferred after the issue of Notice Inviting Tender and before tender opening and where the new incumbent is yet to obtain his digital signature certified.
